Terms and Conditions
By accepting these terms and conditions, you declare the following:
- Please note that fully completing the required data in the form ("Form") for the free trial period and electronically signing it (via the designated button) is equivalent to contractual acceptance of this document and its appendices;
- Please note that the subscription to the service only becomes effective upon receipt of the confirmation of successful activation sent by "Review4You" via email ("Welcome Email");
- After having read and unconditionally accepted all provisions and clauses in this document, which are set out in full below;
- After having read, understood and accepted the economic conditions contained in this document;
- After having read, understood and expressly accepted the following provisions of the Terms and Conditions, in accordance with and for the purposes of Article 1341 of the Civil Code: “SERVICE OPERATION”; “WARRANTIES”; “UNAUTHORIZED USE”; “INTELLECTUAL PROPERTY AND COPYRIGHT”; “LIMITATIONS OF LIABILITY AND IMPOSSIBILITY”; “CHANGES TO THESE TERMS”; “CONFIDENTIALITY AND PRIVACY”; “EXPRESS TERMINATION OF THE CONTRACT”; “TRANSFER OF THE CONTRACT”; “NULLITY”; “APPLICABLE LAW AND JURISDICTION”; “PERSONAL DATA”; “GENERAL PROVISION”.
DEFINITIONS
For the purposes of these Terms and Conditions and the Appendices, the definitions set out in this article apply.
Subscription: this is the period during which the customer, after completing registration and payment of the monthly fee, uses the platform services. The cost of the subscription is closely linked to the number of activities the customer enters into his/her account.
Customer account: this is the main account, created directly by the customer, with which you can manage your subscription.
User or user account: these are the usage licenses with limited functionality of the service that are activated through the customer account.
Appendix(es): these are the legally valid documents that can be consulted on the website, including but not limited to: the privacy policy and the cookie policy.
Activity: refers to one or more of the business activities managed by the Customer and linked to the Customer account.
Carousel: this is the mode with a horizontal interface for using the widget function. This function allows the customer to display the 15 most recent reviews.
Chat: this is the support service included in the platform. It is an external service that allows the customer to communicate directly with a company employee to receive the necessary support.
Customer(s): is the natural and/or legal person who, in the context of his/her business activities, uses the service offered by the company.
“Review4You” is a replacement for the company “Jevy Group” – “Tomatenmarkt 44A, 1681PH Zwaagdijk-Oost, Netherlands” – mail: “ [email protected] “
Feed: this is the mode with a vertical interface for using the widget function. This function allows the customer to display the 15 most recent reviews (including text).
Features: these are the functions of the platform that the customer can access by visiting the website.
Integrations: this is the function within the platform that allows the customer to import public reviews from external sites such as Facebook, Google, TripAdvisor, etc.
Stakeholders: these are the customers and/or users of the client who are invited to review the activity. They must be informed in advance by the client about the purpose of processing personal data and the use of the service offered by “Review4You”.
Free subscription: this is the free subscription offered by "Review4You" that starts upon receipt of the welcome email.
Public reviews: these are reviews published on external websites and integrated into the platform.
Private reviews: these are reviews that the customer receives on the platform and chooses to keep confidential.
Registration: is the phase of concluding a subscription, as described in the 'Service Features' section of this document.
Sectors: these are the areas in which activities take place.
Service: is the innovative system developed by “Review4You”, which allows customers to integrate, manage, monitor and share public reviews, and to send review requests to interested parties.
The website is owned by the domain “www.review4you.nl” and is owned by “Review4You”.
Software and/or platform: this is the platform conceived, designed, built and marketed by “Review4You”, and accessible via the domain “app.review4you.nl”.
Terms and conditions: this document governs the general terms between “Review4You”, its customers and all associated user accounts.
Widget: a computer function that allows, via a link from the platform, the best and most recent reviews about one's activity to be displayed on the website.
SUBJECT
These terms and conditions and the appendices on the website govern the contractual relationship between “Review4You”, the owner and administrator of the platform, and the customers. Acceptance of the terms and conditions and the appendices by the customer is a condition for starting the free subscription and activating the subscription.
The customer declares that he/she has carefully read these terms and conditions and the appendices before submitting the form and starting to use the service.
The customer may, without physically signing a paper form, sign these terms and conditions and the appendices and thereby confirm full acceptance by filling in the required data in the form and then clicking the appropriate button.
By clicking the above button, you agree to all provisions of the Terms and Conditions and the Appendices, as well as the regulations contained therein. The validity of this acceptance also extends to the registration phase.
By completing the form, the customer also accepts that "Review4You" sends information by email and/or SMS to facilitate the use of the service.
SERVICE DESCRIPTION OPERATION
“Review4You” operates in the IT sector and offers customers a service that allows them, via their customer account, to register activities within their own sector and use the functionalities described below.
Through integrations, the customer account can manage and merge public reviews. The best public reviews can then be displayed via widgets on the website of the relevant activity.
In addition, the customer account can, by entering the data of the data subjects, send them emails, SMS and/or WhatsApp messages to ask them to review the activity they have used, thanks to the "Send link" function.
The customer account can also choose to automatically send a review request to the data subjects via the 'Automate' section.
FUNCTIONALITY
- Feedback Manager is the section that allows the customer to track and analyze the flow of received public reviews.
- My activities: in this section, the customer can add, delete, update and/or manage activities (categorized by sector) and integrations.
- Send links: through this functionality, the customer sends requests to stakeholders to submit reviews via email, SMS and/or WhatsApp messages using a link automatically generated by the platform (the "Link"). Stakeholders who click the "Positive experience" button can choose which external website (Facebook, Google, TripAdvisor, etc.) to post their review on. If stakeholders click the "Negative experience" button, they are redirected to a form that they must fill out. The answers to this form are then imported into the negative reviews section.
- Edit template: thanks to this functionality, the customer can edit the text included in the email, SMS and/or WhatsApp messages sent via the 'Send requests' function. Additionally, the customer can customize the templates for messages shared on social media via the 'Social media posts' function.
- Site widget: through this section, the customer can, via a link, display the latest and best public reviews on the website of the relevant activity, in carousel, feed, pop-up, badge and video modes.
- Affiliation: this is the section in which the customer account enters the data of external companies that wish to use the service. If these companies complete the registration procedure, the customer account becomes an affiliate. The affiliate receives a commission of 20% of the relevant subscription amount for each external company, which the company invoices monthly.
- Share on social media: this is the platform functionality that allows the customer to link their social media profiles to share public reviews on social media platforms (Facebook and Instagram) via template editing.
- Analytics data: functionality to monitor the growth and spread of reviews.
ACCESS TO THE SERVICE
The customer who wishes to use the service has two different options:
1. book a demo and then start the free subscription;
2. start the free subscription directly.
Demo
Potential customers can book a 30-minute video call with a company employee to receive a free demonstration of the service and its associated features. Booking is done via the external website www.calendly.com, to which the potential customer is redirected. The company is not liable for any malfunctions of this website. The following data is required from the potential customer to book the demo: first and last name; email address; company name.
The company reserves the right to send the customer a reminder of the date and time of the scheduled demonstration.
Trial period
By entering the data requested by the company and clicking on "try it free for 14 days", the potential customer (after receiving the welcome email) has the opportunity to try the services of "Review4You" free of charge for 14 days. After this period, the customer, if he/she wishes to continue using the services, must start the registration procedure.
It is noted that during this period the company reserves the right to send emails regarding the functions described above.
The following data is required from the customer to start the trial period:
- email address and new password (the "Credentials");
- first and last name;
- company name;
- company logo (optional);
- phone number (optional).
After the customer has entered the data to start the trial period, he/she can perform the integrations.
REGISTRATION, VERIFICATION, CANCELLATION
Registration and verification
The registration procedure begins only after the trial period and ends after entering the payment method via "Add card" and completing the registration form ("the Form"). After completing the registration procedure, the customer receives an email confirmation of successful registration ("Confirmation Message") and the subscription is activated. The customer can then access his/her profile by entering the credentials he/she has chosen and can continue to use the services for the entire duration of the subscription.
The following data must be filled in the form:
- First and last name;
- Billing address;
- Payment details;
- Company name;
The customer is obliged to immediately notify the company of any changes to the data entered in the form. This data is stored in the customer's personal profile and processed in accordance with the privacy policy of “Review4You”, which can be found in the “Privacy Policy” section of the website.
If the customer has a complaint about irregularities regarding the processing of his/her personal data provided during registration, or simply wishes to request its deletion, he/she can contact the company via the following email address “[email protected]” stating “REQUEST FOR DELETION OF PERSONAL DATA” as the subject.
Cancellation
The customer has the option to cancel the subscription at any time by clicking the 'cancel subscription' button. In that case, the company reserves the right to ask the customer certain questions about the reasons for cancellation. It is clear that not answering these questions does not prevent the customer's cancellation. After the cancellation request, the company sends a confirmation email.
Conduct rules and obligations of the parties
From the moment of receipt of the welcome email, the customer is obliged towards the company to:
- Use the Platform in accordance with the conditions described in this document and take all necessary security measures to prevent data from being provided to unauthorized third parties;
- It is not permitted to reproduce, extract, reconstruct or reuse any element of the Platform in any way, form or medium;
- The software and services must be used in accordance with applicable legislation, in particular with regard to Legislative Decree no. 206 of 2005, the so-called "Consumer Code", in particular regarding the prohibition of misleading, unfair or aggressive commercial practices, and the privacy provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data, as well as legislation on intellectual property, image rights and e-commerce.
Both the company and the customer undertake, each within their own competence, to do the following:
- Take all legally required security measures that are appropriate to ensure the physical and logical protection and security of their documents, data and/or information and in general of their computer system;
- Act in accordance with the legal provisions on the protection of safety in the workplace (Legislative Decree 81/08 and subsequent amendments and additions), the protection of personal data (Legislative Decree 196/03 and subsequent amendments and additions, as well as EU Regulation 2016/679 – hereinafter "GDPR"), the civil and criminal protection of programs, data, computer systems, electronic communications and databases and supervise the work of its employees;
- Carry out all required communications to the relevant tax and administrative authorities in connection with the digital storage of the documents declared that relate to or are connected to the Services and this document.
The Service and all rights thereto are and shall remain the property of the Company, which, by entering into these Terms and Conditions, does not intend to transfer any rights to the Services to the Customer.
The customer agrees to fulfill and execute in good faith the agreements made and obligations arising from the use of the services.
CONSIDERATION
The customer agrees, in exchange for the preparation, management and delivery of the services, to pay a monthly fee to the company for each activity related to the customer account (the "Fee").
The company may use discount vouchers, coupons and/or functional promotions to revise and/or differentiate the amount of the fee.
It is established that the invoicing of the Fee by the Company will be carried out within 12 (twelve) days after the activation of the Subscription, also checking the correctness of the data entered by the Customer (the "Verification") and if an error is found, it will be communicated to the Customer for necessary correction.
Payment terms, delays and termination
The customer is obliged to pay the costs monthly or annually via the payment method specified during registration.
The customer is given the opportunity to withdraw from the service and terminate the subscription by activating the termination procedure, as explained above.
CONTRACT DURATION
The contract has a duration of one month and is automatically renewed for the respectively agreed duration (1 month), unless the customer decides to follow the termination procedure described above. The customer's right to terminate the contract for justified reasons remains unaffected.
SERVICE MANAGEMENT
The company will provide its services with its organization and management entirely at its own risk, in a professional manner and in accordance with the quality standards and technical characteristics that are common in business practice regarding activities such as the subject of the service itself. The company undertakes to carry out all necessary, useful and functional activities, according to the principles of fairness and good contractual faith, for the preparation, organization and management of the services for the benefit of the customer.
AUXILIARIES
For the performance of all activities that are necessary, useful or functional for the preparation, management, delivery and provision of the Services, the Company and the Customer may use their own trusted collaborators, employees or partners. In this regard, each of the parties is responsible for the work of its own auxiliary persons. All economic and legal relationships exist directly and exclusively between each party and its auxiliary persons.
WARRANTIES
The warranty rights of customers are governed by the applicable regulations, including those relating to the software license, its duration and revocability, and the provision of services related to its use.
SOFTWARE SECURITY AND WARRANTY
To ensure the proper functioning of the service and in particular the security of the data loaded and stored in the software, “Review4You” uses anti-intrusion software and protocols.
If the customer experiences problems with the operation of the software, he/she can request support via chat or send an email to [email protected] with a description of the problem.
“Review4You” reserves the right to resolve the problem presented by the customer, directly or through designated third parties.
During the term of the contractual relationship, “Review4You” guarantees the customer the necessary support for the software.
It is clear that "Review4You" cannot be held liable for damage directly or indirectly caused to customers, if that damage results from the customer's intent or gross negligence.
WARRANTY LIMITATIONS
It is clear that the warranty, except in cases of intentional misconduct on the part of "Review4You", does not cover replacement for damage and/or malfunctions directly or indirectly resulting from:
- unforeseen events or force majeure (such as, but not limited to: floods, building collapse, natural or biological events, etc.);
- misuse of the software (such as, but not limited to: manipulating it or using it for purposes other than enjoying the services);
- intentional misconduct, negligence, inexperience, recklessness on the part of the customer;
- Temporary interruption of the operation of the software due to periodic and necessary maintenance.
The customer, for himself and his legal successors, indemnifies “Review4You” from any liability for “consequential damages” or “loss of profit”, such as loss of income, arising from the unavailability or failure of the software during the time necessary for repair, maintenance and/or upgrades.
UNAUTHORIZED USE
Customers may not:
- It is prohibited to reverse-engineer, disassemble and/or modify the software, or to create derivative works from the code of the software or any part thereof;
- circumvent computer systems used by "Review4You" and/or its licensors to protect the content of the software and customer documents;
- copy, store, modify, adapt or in any way alter the content of the software;
- It is not permitted to use robots, spiders, website search and retrieval applications or other automated devices, processes or means to access or retrieve technical specifications of the software.
- Resell, rent, license or sublicense the Services without prior consent of the Company;
- It is prohibited to distribute or publish illegal, obscene, unlawful, defamatory or inappropriate content and/or otherwise combine it with the "Review4You" brand;
- publish and advertise other services with the same or similar specifications as those of "Review4You";
- provide false or defamatory information about “Review4You” and its services to third parties;
- It is not permitted to use the services offered by “Review4You” in any other improper manner that is contrary to these terms and conditions and the content of additional documents on the website;
- Respond to public and/or private reviews with content that is inappropriate, defamatory, illegal, obscene, unlawful and/or offensive.
- It is not permitted, when editing the request for release of the review in the designated section entitled 'Edit Template', to use language that is defamatory, misleading and/or likely to incite violence;
- in violation of applicable law in the aforementioned matters.
If the actions of the Customer in form and content violate the above requirements, or if compliance entails economic, reputational damage or legal risks for "Review4You", "Review4You" reserves the right to immediately terminate the service to the Customer. In that case, "Review4You" will inform the Customer by email of the reasons and the manner in which the service is terminated.
INTELLECTUAL PROPERTY AND COPYRIGHT
The customer acknowledges that the company is the sole owner of the intellectual property rights with respect to the software (including trademark rights, copyrights on the texts and graphical interfaces of the company and in general all materials and processes used in the company's business operations) and that these rights are protected by applicable law (including legislation on industrial property, copyright and competition).
It is therefore clear that any use not in accordance with this agreement, or any use after the expiry, termination or otherwise termination of the contractual relationship, constitutes a violation of the company's rights.
All trademarks, both figurative and denominative, and all other signs, trade names, service marks, word marks, illustrations, images and logos that may be registered in the name of "Review4You" and relate to the Services or the Software, are and shall remain the exclusive property of the Company or its licensors, in accordance with applicable national and international intellectual property law.
LIMITATIONS OF LIABILITY AND IMPOSSIBILITY DUE TO FORCE MAJEURE
“Review4You” is, within the limits of applicable regulations, liable for damages of a contractual and non-contractual nature caused to the customer or third parties, only when these are an immediate and direct consequence of intent or gross negligence.
The customer expressly indemnifies and releases “Review4You” from any liability, to the extent permitted by applicable law, with respect to damages or claims, of itself and/or third parties, of any nature whatsoever, including direct or indirect incidental damages to persons or property, damages resulting from loss of profit, reputational damage, loss of data, replacement costs, arising from the customer's non-compliance or violation of these terms and conditions.
If the Company is unable to guarantee the use of the Services due to unforeseen circumstances, it will immediately notify the Customers in writing and indicate whether it concerns a total or partial impossibility.
In the first case, the contractual relationship is deemed to be terminated by operation of law pursuant to Article 1463 of the Italian Civil Code, provided that the service provision is guaranteed under the conditions agreed and duly paid up to that point.
In the second case, the company will, at the customer's request, continue to perform that part of the service that is still feasible, but the user is entitled to a corresponding reduction in the fee, proportional to the duration of the hindrance and the remaining utility of the services during the period of partial performance.
CHANGES TO THESE TERMS
“Review4You” reserves the right to change the provisions of this document and the appendices at any time and for reasons at its own discretion.
Any changes will be communicated to the customer by email and/or via a message on the website. Changes take effect on the first day of the first month following the month in which the company notified the customer in writing, unless legal provisions or administrative measures impose or result in an earlier or later effective date.
In case of disagreement, the customer may withdraw from this document and the service free of charge by means of an email message to be received by the company no later than fifteen calendar days after receipt of the notification of the change to the terms.
In that case, the withdrawal becomes effective at midnight on the day preceding the day on which the changes would otherwise have taken effect.
In case of cancellation, the company only invoices the customer for the services provided to the customer up to the effective date of cancellation.
The customer who chooses to continue using the service or has used it after the change(s) of one or more parts of the aforementioned documents by "Review4You" automatically accepts the new terms and conditions.
CONFIDENTIALITY AND PRIVACY
Each party undertakes – and to ensure that its helpers also do so – to maintain absolute confidentiality and secrecy with respect to any aspect, news and information concerning the business activities of the other party of which it becomes aware during the term of the contractual relationship, including but not limited to news or information regarding the organization, know-how, customer base, services, products and the applied contractual conditions.
EXPRESS TERMINATION OF THE CONTRACT
“Review4You” has the right to terminate the contractual relationship pursuant to Article 1456 of the Italian Civil Code if one of the following events occurs, which is considered a serious breach of contract:
(a) the use of false references, false documents or otherwise not attributable to the Customer, including mentioning promotional codes/actions without being entitled to do so;
(b) non-payment or late payment of amounts due within the time limit set herein;
(c) if the Customer, despite a written warning, does not cease a serious violation of these Terms and Conditions or does not immediately remedy the consequences of such violations that have already occurred;
(d) in case of improper use by the Customer of the benefits arising from the allocation of certain agreements or arrangements existing between “Review4You” and third parties.
Termination occurs by means of a written notice addressed to the contact details provided by the customer during registration or updated later. In any case, the right of "Review4You" to claim further damages remains unaffected

TRANSFER OF THE CONTRACT
“Review4You” reserves the right to transfer, assign, dispose of by way of novation or outsource all of its rights or obligations under these Terms and Conditions, provided that the Customer's rights hereunder are not impaired.
The customer may not transfer or assign his rights or obligations under these terms and conditions in any way without the written consent of "Review4You".

NULLITY
If any provision of these Terms and Conditions is declared null and void, voidable or, more generally, invalid, this does not affect the nullity, voidability or invalidity of the remaining provisions, which shall remain in full force and effect.
If any provision of these Terms and Conditions is declared invalid, it shall be modified in good faith to meet the revised validity requirements or the balanced legality criteria. After modification, the amended provision shall be deemed valid from the outset.
APPLICABLE LAW AND JURISDICTION
All disputes regarding the implementation, compliance, interpretation and validity of these Terms and Conditions and the Appendices are subject to European law. "Review4You" and the Customer undertake to first try to reach a mediation attempt by means of a notification to both addresses, stating the details of the dispute. If the mediation attempt is not successful within 60 days of said request, the said parties undertake to submit the dispute, within the limits of applicable law, to the Italian courts, with exclusive jurisdiction in the court of Rome.
PERSONAL DATA
As independent data controllers, both the Company and the Customer undertake to fully process the personal data of which they become aware in the context of this contractual relationship in accordance with the purposes of the Service and in any case in the manner and under the conditions required by law (primarily Article 13 of the GDPR). The Company, as data controller for customer data, undertakes to process the personal data obtained in the context of the provision of the Services in the manner and for the purposes set out in the privacy policy, which can be consulted in full at www.review4you.nl.
GENERAL PROVISION
By using the service, you accept these terms and conditions in full.
By accepting these terms and conditions, the customer declares that he/she has read and understood their content. He/she also declares that he/she will comply with the provisions regarding usage restrictions.
SUPPORT – CUSTOMER SERVICE
If the customer experiences problems using the service or wishes to exercise any of the associated warranties, he/she can report this via the support chat or, alternatively, send an appropriate notification with a description of the problem to “Review4You” at the following addresses:
